Pending before the Court is Defendant's Motion for Reconsideration (Doc. No. 40). After considering the motion, the responses thereto, and the applicable law, the Court finds that Defendant's motion for reconsideration must be GRANTED and Plaintiff's due process claim brought pursuant to § 1983 dismissed.
