This cause is before the Court on Defendant's Motion to Dismiss on the Basis of Qualified Immunity, Sovereign Immunity, and Under Heck v. Humphrey. Having considered the pleadings1 as well as supporting and opposing authorities, the Court finds the Motion should be granted in part, and denied in part.
