OPINION AND ORDER
BESOSA, District Judge.
On March 13, 2012, defendant Rafael Colon-Quiles ("Colon-Quiles") filed a motion to dismiss the indictment against him for possession of a revolver with an obliterated serial number in violation of 18 U.S.C. § 922(k). (Docket No. 25.) Defendant Colon-Quiles alleges that section 922(k) is unconstitutional because it is not a valid exercise of Congress's authority
