On May 8, 2001, petitioner Narval Narcissi was convicted, following trial by jury, of Criminal Possession of a Weapon in the Second Degree (New York Penal Law ("Penal Law") § 265.03(2)). Narcissi is serving a determinate term of imprisonment of 15 years to be followed by two and a half years of post-release supervision.
