Pavel Petrashishin brings this suit seeking declaratory judgment.

On or about July 11, 2007, plaintiff executed a deed of trust in which Mortgage Electronic Registration systems, Inc. (MERS) is listed as the beneficiary, solely as the nominee of the lender, America's Wholesale Lender. The deed secures a promissory note executed by plaintiff for a loan to purchase real property in Happy Valley, Oregon.
