Presently before the Court is Defendant Miele USA, Inc.'s ("Miele" or "Defendant") motion to dismiss Plaintiff Daisy Montich's ("Montich" or "Plaintiff") Complaint for failure to state a claim pursuant to Fed. R.Civ.P. 12(b)(6). Plaintiff filed her four-count Complaint on behalf of herself and a putative class alleging that Defendant (1) violated the New Jersey Consumer Fraud Act, N.J.S.A. § 56:8-1 et seq. ("NJCFA")...
