This matter comes before the court on defendant Martin Garnett's motion to dismiss the indictment in this case based on the Sixth Amendment's Speedy Trial Clause. Mr. Garnett was serving a lengthy sentence when he was indicted in this court in 2002 for smuggling heroin into this district while imprisoned in Thailand.
