MEMORANDUM OPINION AND ORDER

Pending before the Court are the parties' cross-motions for summary judgment, and Plaintiff's motion to amend, alter, or vacate this Court's Judgment entered on January 6, 2011, pursuant to Rule 59(e) of the Federal Rules of Civil Procedure. For the following reasons, the Court DENIES the summary judgment motion by Plaintiff Algernon W. Tinsley [doc. no. 77], GRANTS
