Plaintiff Suntree Technologies, Inc. ("Suntree") brings claims of trademark infringement, false advertising, and deceptive and unfair trade practices against its competitor—EcoSense International, Inc. ("EcoSense")—and EcoSense's President, George Dussich ("Dussich") (collectively "Defendants"1). Suntree, EcoSense, and Dussich have all moved for summary judgment.
