I. BACKGROUND

In May 2002, Ashante Legard, a Louisiana resident, was prescribed the Ortho Evra® birth control patch by Dr. Kirk Rousset. Ms. Legard used the patch until May 10, 2006, when she contacted Dr. Rousset's office to complain of pain in her left leg for approximately three months.
