These matters come before the Court on confirmation of the fourth amended Chapter 11 plan of reorganization (the "Plan") filed by Nachshon Draiman (the "Debtor") and the objections thereto filed by Dynegy Marketing and Trade ("Dynegy") and on the motion of Dynegy to dismiss or convert the case.1 For the reasons set forth herein, the Court sustains in part Dynegy's objections...
