On April 19, 2010, Baljit Singh filed his first petition for a writ of habeas corpus under 28 U.S.C. § 2241 challenging his detention in the custody of the Department of Homeland Security ("DHS") on the grounds that it was not statutorily authorized and it violated due process guaranteed by the Fifth Amendment.
