IRENAS, Senior District Judge:

This matter appears before the Court on Defendant's Motion to Dismiss the Third Count of the Amended Complaint, pursuant to Federal Rule of Civil Procedure 12(b)(6).1 Defendant also seeks to dismiss Plaintiff's claims for punitive damages and attorney's fees.
