Plaintiff Girafa.com, Inc. ("Girafa") initiated this patent infringement suit pursuant to 35 U.S.C. § 271 on December 5, 2007, alleging that defendant Smartdevil Inc. ("Smartdevil"), among others, infringed upon U.S. Patent No. 6,864,904 ("the '904 patent").
