This matter is before the court upon plaintiff's objections to the report and recommendation of United States Magistrate Judge Susan Richard Nelson dated July 30, 2007. In her report, the magistrate judge recommended that defendant's motion to dismiss be granted. For the following reasons, the court adopts the report and recommendation in its entirety.
