Pending before this Court is Defendant Diego Figueroa Torres' ("Defendant" or "Figueroa") Motion for Summary Judgment (Dockets # 83), and Plaintiff Wendel Delgado Sánchez's ("Plaintiff" or "Wendel") opposition thereto (Docket ## 87 and 89).
