This case brought under the Freedom of Information Act ("FOIA"), 5 U.S.C. § 552, is before the Court on cross-motions for summary judgment.1 For the reasons stated below, the defendant's motion for summary judgment will be granted and the plaintiff's motion for summary judgment will be denied.2
