This matter comes before the Court on motion of Defendant Delaware River Port Authority ("Defendant" or "DRPA" where appropriate) to dismiss Plaintiff Peter Zilahy Ingerman's Complaint in lieu of answer pursuant to Federal Rule of Civil Procedure 12(b)(6).
