The question presented in this appeal is whether the defendant, Yadeil Figueroa, was deprived of his constitutional right to conflict-free representation when his attorney's allegedly improper conduct became a significant issue in his trial.1 Because the defendant has demonstrated an actual conflict of interest that adversely affected his counsel's performance; see Mickens v. Taylor, 535 U.S. 162
