BORDEN, J.

The sole question of this appeal is whether the defendant, the town of Madison, may be sued under the Connecticut Unfair Trade Practices Act (CUTPA), General Statutes §§ 42-110a et seq., for allegedly overcharging for building permit fees. We answer the question in the negative and, accordingly, affirm the trial court's summary judgment in favor of the defendant.
