Plaintiff-Debtor, James L. Macklin ("Plaintiff"), moves the court for summary judgment or summary adjudication pursuant to Federal Rule of Civil Procedure 56, made applicable to this proceeding by Federal Rule of Bankruptcy Procedure 7056.
