JURY, Bankruptcy Judge.

Appellee, Aussie Sonoran Capital, LLC ("ASC") scheduled a trustee's sale of chapter 131 debtor's property after its predecessor in interest obtained relief from stay. On the day of the sale, debtor, Anna Leafty, dismissed her previous bankruptcy case and filed the instant case. ASC then moved to dismiss debtor's second bankruptcy case, to confirm the prior order which terminated the automatic stay...
