This matter comes before the Court on the application (the "Application") of Archer Capital Fund, L.P., ("Archer") for the entry of a Court order dismissing the chapter 11 cases of GEL, LLC ("GEL") and GRL, LLC ("GRL" and together with GEL, the "Debtors") with prejudice pursuant to §§ 362(d)(4), 707(A) and 1112(b) of title 11 of the United States Code (the "Bankruptcy Code").1
