The applications for further appellate review are denied. We recently granted further appellate review in a case raising similar issues, SJC-11106, COMMONWEALTH vs. MATTHEW G. LAVOIE. The better course here, however, is to allow this case to proceed immediately in the Superior Court on remand and for the judge forthwith to make the findings required by the Appeals Court.
