OPINION AND ORDER

SEIBEL, District Judge.

Before the Court are Plaintiffs Motion for Summary Judgment, (Doc. 71), and Defendants-Intervenors'1 Cross-Motion for Summary Judgment, (Doc. 78). For the reasons set forth below, Plaintiff's Motion is GRANTED IN PART and DENIED IN PART and Defendants-Intervenors' Motion is DENIED. Both denials are without prejudice to renewal following limited additional discovery.
