OPINION AND ORDER

EDMUND A. SARGUS, JR., District Judge.

This matter is before the Court on Defendants' Motion for Summary Judgment (Doc. 148), Plaintiffs Motion for Summary Judgment (Doc. 147), and Plaintiffs Motion for Leave to File Surreply (Doc. 172). For the reasons that follow, the Court GRANTS IN PART AND DENIES IN PART both summary judgment motions and GRANTS the plaintiff's motion to file a surreply.
