Presently before us is Defendant Prudential Insurance Company of America's ("Prudential") Motion for Summary Judgment, filed September 17, 2009. (Doc. 8.) Plaintiff Albert J. Serino ("Serino") alleges that Prudential breached its contract with him by not paying him disability insurance benefits to which he was entitled and that this breach was in bad faith.
