Before the Court is a motion1 to dismiss filed by defendant, Harris Builders, L.L.C. ("Harris"), pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure. Plaintiffs have opposed the motion.2 For the following reasons, Harris's motion is DENIED.
