(Doc No. 40) and Defendant Molina Healthcare's Motion for Summary Judgement ("Molina Mot.") (Doc. No. 42). For the reasons set forth herein, El Paso Healthcare System's Motion is DENIED and Molina Healthcare's Motion is GRANTED
