This case is presently before me upon Plaintiff Kimberly-Clark's ("K-C") motion for a preliminary injunction to prohibit Defendant Tyco Healthcare Group LP (d/b/a "Covidien") from marketing and selling a line of endotracheal tubes under the "SealGuard" trademark. K-C alleges that the SealGuard products infringe U.S. Patent No. 6,526,977, the rights to which K-C acquired in 2005 from a German company...
