This medical malpractice appeal comes before us for the second time, on remand from the Court of Appeals. See Barber v. Catholic Health Initiatives, Inc., 174 Md.App. 314, 921 A.2d 811 ("Barber I"), vacated, 400 Md. 396, 929 A.2d 155 (2007) (per curiam) ("Barber II").1
