The defendant, Edward Fizer, was charged with distribution of cocaine, contrary to La. R.S. 40:967(A). Pursuant to a plea bargain, he pled guilty as charged with a 10-year sentencing cap, and the state agreed not to file a habitual offender bill. The defendant was sentenced to serve 10 years of imprisonment at hard labor, the first two years to be served without the benefit of probation, parole or suspension of sentence.
