Presently before the Court is Defendants' Motion to Dismiss (Doc. No. 9) and Plaintiffs' Response (Doc. Nos.10, 11). For the Reasons that follow, Defendants' Motion (Doc. No. 9) is GRANTED in part and DENIED in part.
