Presently before the Court is Defendant's Motion to Dismiss Plaintiffs Declaratory Judgment Complaint for Lack of Subject Matter Jurisdiction pursuant to Fed.R.Civ.P. Rule 12(b)(1) (Doc. No. 2).1 For the reasons given below, the Court denies Defendant's Motion to Dismiss.
