[¶ 1.] On September 2, 2004, Karyl Michelle Condon (Condon) was indicted by a Minnehaha County grand jury on one count of grand theft. A jury trial was held in the South Dakota Second Judicial Circuit on January 24 and 25, 2005, after which Condon was found guilty of the charge.1 On July 12, 2006, Condon filed a motion for a new trial pursuant to SDCL 15-6-59(a)(4).
