This matter is before the Court for consideration of the Motions for Summary Judgment filed by Plaintiff (Doc. # 37, # 41) and by Defendants (Doc. # 36). For the reasons that follow, the Plaintiffs motion is GRANTED and the Defendants' motion is DENIED.
