On March 27, 2002, Jackie G. Parker was allegedly injured when a vehicle driven by Elias Esteban Silviano rear-ended his car. Parker and his wife Carolyn filed claims, respectively, for personal injury and loss of consortium against Silviano and his employer Anthony Peterson on March 19, 2004, approximately one week before the two-year statute of limitation on the personal injury claims expired.
