Jason Terry was charged with driving under the influence of alcohol to the extent that it was less safe for him to drive and with driving with an unlawful blood alcohol concentration. After denying Terry's motion to suppress, the trial court conducted a bench trial at which it found Terry guilty of both DUI charges based on stipulated evidence, but merged the former into the latter for purposes of sentencing.
