ORDER
FLANAGAN, Chief Judge.
This matter comes before the court on defendant's motion to dismiss the amended complaint (DE # 55) pursuant to principles of comity and Fed.R.Civ.P. 12(b)(1) and 12(b)(6), filed August 30, 2006.
