Robert F. Hinely, Jr. sued his former employer for breach of an employment contract and related torts. The State Court of Fulton County granted summary judgment to the former employer on the ground that Hinely's claims had already been litigated in a prior federal court action. We hold that the federal action did not preclude Hinely's claims in this case and that summary judgment was improperly granted on some of them. Accordingly, we affirm in part...
