Petitioner's five-year-old daughter was injured in January 2005 while playing on the playground slide at the "Kindergarten Campus" of the Waverly Elementary School in the Village of Waverly, Tioga County. In November 2005, petitioner sought leave to serve a late notice of claim against respondent. Supreme Court granted the application and respondent appeals.
