I. Introduction

Defendant Bryan Joseph Brubaker was charged in a one-count indictment with distribution of a controlled substance resulting in death, in violation of 21 U.S.C. §§ 841(a)(1) and (b)(1)(C). According to the government, Brubaker knowingly distributed Oxycodone to Eric Jacobson who later sold a portion of that Oxycodone to Jessica Lawhorn. Lawhorn died as a result of her consumption of the drug....
