On September 13, 1999, defendant was convicted upon his plea of guilty of, among other crimes, criminal possession of a controlled substance in the second degree—a class A-II felony— and was sentenced to a prison term of eight years to life on such conviction. His subsequent appeal to this Court resulted in an affirmance (2 A.D.3d 982 [2003], lv denied 1 N.Y.3d 602 [2004]).
