In February 2004, defendant was indicted for course of sexual conduct against a child in the first degree and endangering the welfare of a child. According to the indictment, on or about February 2003 through May 2003 in the Town of Mamakating, Sullivan County, defendant had two or more sexual contacts with the nine-year-old victim. Following a jury trial, defendant was convicted of both charges and sentenced as a second felony offender to a term of imprisonment...
