In this appeal we are asked to decide whether a juvenile court has jurisdiction to award custody to a formerly non-custodial parent when the Department of Social Services ("the DSS") dismisses a CINA petition without having sustained any of the allegations against the formerly custodial parent.1 As we shall discuss, infra, the DSS has moved to dismiss this appeal on mootness grounds.
