Presently before the Court is a Motion for Summary Judgment filed by the Defendant, Dillard's, Inc. ("Dillard's"). (Doc. # 128). The Plaintiffs, Rodney Green and Charlan Green (collectively "the Greens"), who are African-American, claim that Dillard's violated 42 U.S.C. § 1981 (" § 1981") when one of its sales clerks uttered a single racial epithet which the Greens overheard while shopping at Dillard's Metro...
