This matter comes before the Court on defendants' motion to dismiss plaintiffs' amended complaint (Doc. 44). Plaintiffs have responded to defendants' motion (Doc. 46) and defendants have replied (Doc. 48). Also pending before the Court is plaintiffs' motion for preliminary injunction (Doc. 3). For the following reasons, defendants' motion will be DENIED IN PART AND GRANTED IN PART and plaintiffs...
