The plaintiff, Henry T. Roark, was injured in an automobile accident on November 12, 2003, in Lynchburg, Virginia. The accident occurred when Roark's vehicle was rear-ended on the on-ramp of an expressway in Lynchburg, Virginia, by a car that had in turn been rear-ended by a vehicle driven by an FBI agent.
