Before the Court is Plaintiff's Motion to Remand, filed May 18, 2005. Defendants responded in opposition on June 6, 2005. Plaintiff flea a reply on December 29, 2005, and Defendants filed a sur-reply on January 13, 2006. For the reasons set forth below, Plaintiffs motion is DENIED.1
