Tonisha Via sued four employees and officials of the Department of Child Protection ("DCP") within the Illinois Department of Children and Family Services ("DCFS"), alleging claims under 42 U.S.C. § 1983 and Illinois law. The defendants claimed they were entitled to qualified immunity on the federal claims and moved for summary judgment.
